These Terms and Conditions govern your use of the website located at concretehobbs.com and any services provided by Hobbs Concrete ("Company," "we," "us," or "our"). By accessing this website or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use this website or engage our services.
By using this website or by signing any proposal, estimate, or service agreement provided by Hobbs Concrete, you confirm that you have read, understood, and agree to these Terms and Conditions and our Privacy Policy. Hobbs Concrete provides concrete contracting services to residential and commercial customers, including but not limited to concrete driveways, patios, sidewalks, foundations, retaining walls, pool decks, steps, floor installation, decorative and stamped concrete, and related work.
All services are subject to the scope of work agreed upon in a written estimate or contract. Work not specified in a written agreement is not included and may be quoted separately.
All estimates provided by Hobbs Concrete are based on the information available at the time of the site visit and the scope of work described by the customer. Estimates are valid for 30 days from the date of issue unless otherwise noted.
Changes to the scope of work, unforeseen site conditions (including but not limited to subsurface obstructions, unstable soil conditions, or caliche requiring additional excavation), or changes in material costs may result in price adjustments. We will notify you in writing before proceeding with any work that falls outside the original agreed scope.
No work outside the original scope will begin without your written or documented verbal approval and a revised cost estimate.
Project start dates are confirmed upon receipt of any required deposit and execution of a written agreement. Start dates are subject to permit timelines, material availability, and weather conditions. Concrete work may be rescheduled at our discretion due to weather that would materially affect the quality of the finished work (including extreme heat, high winds, or rain).
If you need to cancel or reschedule, please notify us as soon as possible. Cancellations made after materials have been ordered or permits pulled may be subject to costs already incurred on your behalf.
Hobbs Concrete reserves the right to reschedule work due to circumstances beyond our control, including weather, supply chain delays, or labor availability.
Payment terms are specified in the written estimate or contract provided for each project. A deposit may be required before work begins. The remaining balance is typically due upon completion of work unless otherwise agreed in writing.
Payments not received by the due date may be subject to a late fee as specified in the project agreement. Hobbs Concrete reserves the right to suspend work on a project if payment is overdue.
Accepted payment methods are specified at the time of contracting. All prices are in US dollars.
Where required by local or state law, Hobbs Concrete will obtain applicable permits before work begins. Permit fees are either included in the project estimate or itemized separately. The customer is responsible for ensuring that property access and any required easements or approvals are in place before work begins. Delays caused by permit processing are outside our control and do not constitute a breach of our agreement.
Hobbs Concrete performs all work in a professional manner using industry-standard materials and practices. Any workmanship warranty applicable to your project will be specified in your written agreement.
Concrete is a natural material and is subject to normal shrinkage cracking, discoloration, and surface variation. These characteristics are inherent to the material and do not constitute defects. We are not responsible for cracking caused by ground movement, soil settlement, subsurface conditions not identified at the time of estimate, tree root intrusion, or customer misuse.
Except as expressly stated in a written warranty provided with your project, all services are provided "as is" and we make no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
To the maximum extent permitted by applicable law, Hobbs Concreteshall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the services provided or the use of this website.
Our total liability for any claim arising from a project shall not exceed the total amount paid by you for the specific project giving rise to the claim.
If a dispute arises between you and Hobbs Concrete, we encourage you to contact us first so we can work toward a resolution. Most concerns can be addressed quickly through direct communication.
If the dispute cannot be resolved informally, both parties agree to first attempt resolution through mediation before pursuing any litigation. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts in Lea County, New Mexico.
These Terms and Conditions and any agreements entered into with Hobbs Concrete are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.
